'Uncle and niece' prosecuted for having a sexual relationship

A man and woman,  who are said to be uncle and niece, appeared in court accused of incest.


Prosecutors say James Seath and Pamela Seath had sex at a flat in Kirkcaldy, Fife. The pair deny the allegations against them.

On Tuesday Kirkcaldy Sheriff Court heard that lawyers representing Pamela Seath, 25, are challenging the admissibility of crucial DNA evidence in the case.

James Seath, 38, of St Kilda Crescent, Kirkcaldy, and Pamela Seath, of Saunders Street, Kirkcaldy, both pled not guilty on indictment to one charge each of incest.

The charges allege that they had sexual intercourse despite being related by blood as uncle and niece.

Sheriff Andrew McCulloch said: “The question of paternity is not a matter of admission. We will fix a hearing on that evidence.”

The case was continued until later this month for a further pre-trial hearing and a hearing on the admissibilty of the DNA evidence. Both Pamela and James Seath were released on bail until that date.
